{"id":4215,"date":"2020-07-06T10:16:51","date_gmt":"2020-07-06T14:16:51","guid":{"rendered":"https:\/\/vets2industry.org\/new\/?p=4215"},"modified":"2023-09-04T14:26:31","modified_gmt":"2023-09-04T18:26:31","slug":"the-180-day-rule","status":"publish","type":"post","link":"https:\/\/vets2industry.org\/new\/the-180-day-rule\/","title":{"rendered":"&#8220;The 180-Day Rule&#8221;"},"content":{"rendered":"<p><a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/5\/3326\" target=\"_blank\" rel=\"nofollow noopener noreferrer\">Section 3326 of United States Code Title 5<\/a>\u00a0states that a retired member of the Armed Forces may not be\u00a0<strong><em>APPOINTED\u00a0<\/em><\/strong>to a civilian position in Department of Defense (DoD) within 180 days after retirement (without a &#8216;waiver&#8217;).<\/p>\n<p>You can\u00a0<strong><u>STILL<\/u><\/strong>\u00a0apply!<\/p>\n<p>When I was transitioning from the\u00a0Army, I was told I couldn&#8217;t apply for a GS position for 6-months.<\/p>\n<p>WHAT?!?!<\/p>\n<p>I&#8217;m not personally a big fan of people saying I can&#8217;t do something, so&#8230;<\/p>\n<div>I applied for a GS-15 position 45-days prior to my retirement date and still on transition leave.<\/div>\n<ul>\n<li>I was qualified.<\/li>\n<li>I knew the hiring managers.<\/li>\n<li>I was well-respected in the organization.<\/li>\n<\/ul>\n<p>After 25 years in the military, this would be the FIRST job I targeted.<\/p>\n<ul>\n<li>I was referred.<\/li>\n<li>I went through three rounds of interviews.<\/li>\n<li>I was\u00a0<strong><em>NOT\u00a0<\/em><\/strong>selected; a more qualified person was.<\/li>\n<\/ul>\n<p>IF I had been selected (and I accepted), a waiver would have been requested.<\/p>\n<p>That&#8217;s it.<\/p>\n<p>So&#8230;understand the &#8220;rules&#8221; before you let them deter you from applying for a position.<\/p>\n<p><em>*<\/em><strong><em><u>Note<\/u><\/em><\/strong><em>:\u00a0<\/em><a href=\"https:\/\/www.linkedin.com\/company\/moaa\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Military Officers Association of America (MOAA)<\/em><\/a><em>\u00a0and\u00a0<\/em><a href=\"https:\/\/www.linkedin.com\/company\/the-military-coalition\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>The Military Coalition<\/em><\/a><em>\u00a0are working with lawmakers to repeal the requirement for those retiring from military service to wait 180 days before entering DoD civil service General Schedule (GS) positions for GS-13 and below.<\/em><\/p>\n<p><strong><em>ABOUT THE AUTHOR<\/em><\/strong><em>:\u00a0<\/em><a href=\"https:\/\/www.linkedin.com\/in\/matthew-quick\/\" target=\"_blank\" rel=\"noopener noreferrer\"><em>Matt Quick<\/em><\/a><em>\u00a0retired from the U.S. Army January 1, 2019 after 25 years of active service and settled just outside Raleigh, North Carolina.\u00a0He&#8217;s dedicated his military career assisting service members in taking control of their careers and continues assisting service members and their families during the military transition journey.
